Non-Exclusive
By purchasing a non-exclusive design, you as the buyer agree to the following terms:
Dayanna Middleton retains the rights of the image. You will only be purchasing the license to print products within the textile sector (e.g. clothing, blankets, pillows) only. Licenses are non-exclusive for personal plus commercial use and will be sold to multiple buyers at a time. License permits you to print up to 500 items/meters/units. License is for use on physical products only. Because of the nature of this product, there are no refunds. If you’re having issues with the purchase, please reach out to me.
You cannot:
- sublicense, sell, or distribute designs files to any outside party.
- sell design on any digital product/service (e.g. editorials, promotional materials, PDF).
- upload, repost, or resell the standalone design on any website without a proper watermark (e.g. social media, blog).
- You cannot modify the design outside the terms listed under the license.
If you need small tweaks to the design, or if you’re having issues with the design, let me know! I’m able to make small edits if needed.
Violations of these rules will result in lawful action.
Detailed licensing terms below:
- Grant of License
- A non-exclusive license is granted upon payment and is subject to these terms. Artist (Dayanna Middleton) grants you a non-exclusive license to use artwork for use in the following:
- Personal Use:
- You may use this design for personal projects that are not for resale
- Commercial use:
- You may use the design for commercial use for fabric products only (e.g. pillows, clothing, blankets, etc.), and up to 500 units of physical product.
- You may only edit the background color unless otherwise stated
- Duration
- The non-exclusive license lasts until production of physical product surpasses 500 units. License terminates after milestone is passed.
- Ownership and copyright
- Artist retains all rights, title, and interest in and to the artwork, including all copyrights. As buyer, you agree not to claim ownership, seek copyright, or authorship of the artwork.
- Commercial Use Restrictions
- You cannot use or modify the artwork outside of the terms specified in this agreement and on product listing
- You cannot upload, repost, or use artwork on any website or digital product or service
- You cannot resell or redistribute license or the artwork itself as a digital product or service
- You cannot resell artwork on any POD website
- Termination
- The agreement may be terminated by any party (artist or buyer) upon breach by the other party, provided that the breaching party fails to cure said breach within 30 days of written notice
- Additional Terms
- Your license only applies to the artwork as a whole. Elements of artwork may appear in other products and designs for sale by the artist.
- Because of the nature of this product, refunds are not available. If you need any small modifications to your purchased design, please contact me.
